Welcome to Effe Designer Resale. This website is owned and operated by Effe Designer Resale ABN: 19004633407. By visiting and/or purchasing anything from this site, you agree and are bound to the Terms and Conditions (“Terms of Service”, “Terms”).
These conditions extend to all visitors and users of the site. If you do not agree and abide by these Terms and Conditions, do not access the site or use any of the services.
Effe designer resale is an independent reseller of pre-owned luxury items and is not affiliated with any of the brands in this post. All trademarks are reserved to the original brand owners.
1. Changes to Terms and Conditions
a. We reserve the right to modify or replace these terms and conditions at any time. The updated version will be effective immediately upon posting on our website.
b. It the site visitor or purchaser’s responsibility to review these terms and conditions periodically for any changes.
2. Definitions
a. “Site” means the Effe Designer Resale website and all associated pages and content.
b. “Effe”, “we”, “us” or “our” means Evans Leather Pty Ltd, trading as Effe Designer Resale.
c. “you” or “your” means any person or entity accessing the Site, purchasing items, or consigning goods.
d. “Items” means any products offered for sale through the Site, including both Effe Preloved and Effe x Evans Leather Repair pieces.
e. “Effe Preloved” means items sold in their original vintage condition that have not undergone restoration prior to sale.
f. “Effe x Evans Leather Repair” means items that have undergone repair, restoration, or maintenance prior to sale by Evans Leather Repair.
g. “Evans Leather Repair” means Evans Leather Repair, an independent leather repair business that provides restoration and repair services separate to Effe.
h. “Services” means any services offered in connection with the Site, including authentication, listing, and facilitation of sales. For clarity, repair and restoration services are not provided by Effe and are carried out separately by Evans Leather Repair.
i. “Fees” means any amounts payable by you in connection with the purchase of Items or any Services, as specified on the Site.
j. “Consignor” means any person or entity who authorises Effe to sell an Item on their behalf.
k. “Listing Price” means the price determined by Effe at which an Item is offered for sale.
l. “Commission” means the portion of the final sale price payable to the Consignor, as agreed in accordance with these Terms.
m. “Minimum Consignment Period” means the minimum period an Item must remain listed for sale, as defined in these Terms.
n. “Direct Buyout” means the purchase of an Item by Effe directly from you, outside of Consignment.
o. “Intellectual Property Rights” means all present and future rights conferred by statute, common law or equity in relation to copyright, trade marks, designs, patents, domain names, know-how and all other results of intellectual activity.
p. “Privacy Policy” means our privacy policy as published on the Site.
q. “Software” means any software used in connection with the operation of the Site, including all associated code, systems, and technologies.
3. Authentication Guarantee
a. All items listed on our Site are guaranteed to be authentic.
b. Each piece undergoes a rigorous authentication process conducted by the Effe team, including a physical inspection assessing construction, materials, hardware, detailing, and overall consistency with the original design.
c. We utilize Entrupy authentication for every eligible item. Where Entrupy cannot be used (including brands not serviced by Entrupy), authentication is completed via trusted third-party providers such as Real Authentication or LegitGrails.
d. Unless otherwise specified, items authenticated through Entrupy include:
- A digital certificate of authenticity
- A physical A5 laminated certificate, provided with the purchase
e. Ongoing authentication – Entrupy certificates are issued at the time of sale and are not automatically renewed. Should a customer require re-authentication at a later date, this can be arranged upon request and may incur an additional fee.
f. If an item is determined to be inauthentic, it will be removed from sale immediately.
g. In the unlikely event that a customer purchases an item that is later proven to be inauthentic, Effe will arrange for the return of the item and issue a full refund, including any original shipping costs incurred by the customer.
h. This authenticity guarantee applies only to the original purchaser. Any subsequent owners of the item are not eligible to make a claim under this policy.
4. Product Information and Condition
a. We guarantee that all products listed on our Site are authentic. Please refer to Section 3 for our authentication policy.
b. All items are pre-owned and sold in their current condition, as described and depicted in the product listing.
c. Effe offers two distinct categories of products:
- Effe Preloved: Pieces sold in their original vintage condition. These items may show signs of wear consistent with age and use and have not undergone restoration prior to sale.
- Effe x Evans Leather Repair: Pieces that have undergone repair, restoration, or maintenance services prior to listing by leather specialists at Evans Leather Repair.
d. Any restoration, repair, or maintenance performed prior to sale will be reflected in the product listing where relevant. This may include services such as cleaning, conditioning, structural reinforcement, colour refinishing, or waterproofing.
e. All items are maintained as close as possible to their original design and materials. Any variations will be noted in the product description where applicable.
f. It is the responsibility of the customer to carefully review all product images and descriptions, and to request further information, imagery, or a viewing (in-person or virtual) prior to purchase if required.
5. Post-Purchase Care and Services
1. Effe operates independently but collaborates closely with Evans Leather Repair, a specialist leather repair workshop
2. Care guidance: Effe is happy to provide general care guidance following your purchase. However, once an item has been sold, Effe is not liable for any changes in condition, including wear and tear, misuse, or damage.
3. Repair services: Customers may seek repair or restoration services through Evans Leather Repair following purchase. All services are available only after the item has been purchased and are not included as part of the sale. All repair services are quoted, assessed, and invoiced independently by Evans Leather Repair.
All repair and restoration work:
a. Is optional and undertaken at the customer’s discretion
b. Is assessed and quoted independently based on the condition and requirements of the item
c. Is payable by the customer directly to Evans Leather Repair
d. Items purchased through Effe are eligible for 10% off repair services at Evans Leather Repair.
e. This offer applies only to the original purchased item, must be redeemed by the original purchaser, requires proof of purchase (receipt or order confirmation) at the time of booking, cannot be combined with other offers unless stated, is subject to change at the discretion of Effe.
f. Effe does not guarantee the outcome, scope, or suitability of any repair or restoration service. All services are carried out by Evans Leather Repair as a separate business, and any timelines, pricing, or results are determined by them.
g. Customers are encouraged to consult directly with Evans Leather Repair prior to proceeding with any services to ensure they are comfortable with the proposed work.
4. Effe customer benefit: Items purchased through Effe are eligible for 10% off repair services at Evans Leather Repair. This offer:
a. Applies only to the original purchased item
b. Must be redeemed by the original purchaser
c. Cannot be combined with other offers unless stated
d. Is subject to change at the discretion of Effe
5. Legacy waterproofing offer: Customers who purchased an item from Effe on or before 30 April 2026 remain eligible to redeem a complimentary waterproofing service. This offer:
a. Applies only to qualifying purchases made on or before this date
b. Is limited to one use per item purchased
c. Must be redeemed through Evans Leather Repair
d. Does not include or extend to any additional repair or restoration service
e. This offer will not apply to any purchases made after 30 April 2026.
6. CONSIGNING WITH EFFE
- Quotations and Assessment
a. We may provide preliminary quotes or ranges for Items based on photographs. You acknowledge that such quotes are indicative only and that the final Listing Price may differ following physical inspection.
b. All Items are subject to condition, quality and authenticity assessments. We reserve the right, in our sole discretion, to accept or reject any Items for Consignment.
c. Any Items not accepted for Consignment will be returned to you at your expense, and an administration and handling fee may apply.
d. Where repair or restoration is required prior to sale, we may refer you to Evans Leather Repair for a quote. Any repair work is conducted separately to our consignment services. Items undergoing repair are not considered consigned with us until such work is completed and the Item is formally accepted for Consignment
2. Consignment and Listing
a. You agree to consign the Items to us for the purpose of sale. The Items will remain in our possession for the duration of the Consignment.
b. We may photograph, market and list the Items for sale across our website and any third-party platforms, including online marketplaces, social media platforms, and private sales channels, at our discretion.
c. Items may take up to six (6) weeks from receipt to be prepared and listed for sale.
3. Consignment Period and Termination
a. Items will be listed for a minimum consignment period of three (3) months (“Minimum Consignment Period”).
b. You may terminate the Consignment after the Minimum Consignment Period by providing written notice.
c. Following notice of termination, we may continue to offer the Items for sale for a reasonable period to allow for delisting.
d. We reserve the right to terminate the Consignment at any time for any lawful reason.
4. Pricing and Discounts
a. We retain sole discretion to suggest a Listing Price range for the Items. You may select the Listing Price within the provided range.
b. You will be notified of the suggested Listing Price prior to sale and may elect not to proceed, in which case the Items must be returned at your expense.
c. During the Minimum Consignment Period, Items will be listed at the agreed Listing Price and will not be discounted.
d. Following the Minimum Consignment Period, we may propose discounts to facilitate sale. No discounts will be applied without your prior approval, unless otherwise agreed in writing.
5. Commission and Payment
a. You will receive a commission on the sale of each Item, as agreed in writing prior to listing.
b. A minimum commission fee of $300 applies to all Items, unless otherwise agreed in writing.
c. For Items with an agreed Listing Price of less than $1,000, commission will be charged as a flat fee of $300, unless otherwise agreed in writing.
d. For Items with an agreed Listing Price of $1,000 or more, commission will be charged as a percentage of the final sale price, which will be no less than thirty percent (30%), unless otherwise agreed in writing.
e. Where a percentage-based commission applies, the total commission payable may exceed thirty percent (30%).
f. The commission structure will be determined by us and confirmed in writing prior to listing.
g. All commission amounts will be deducted from the final sale price prior to payment to you.
h. We will remit payment of your commission within three (3) business days of receipt of cleared funds from the sale of the Item, to your nominated bank account.
7. Selling to Effe - direct buy out
1. Assessment and Offer
a. We may, at our discretion, assess Items to determine whether they are suitable for Direct Buyout.
b. Any Direct Buyout offer is based on factors including, but not limited to, the Item’s condition, authenticity, brand, and current market demand.
c. Any offer provided by us is indicative only and is not binding until accepted by you in writing.
d. All Items are subject to an authenticity assessment. We reserve the right, in our reasonable opinion, to determine whether an Item is authentic or as described.
e. Where an Item is found to be inauthentic or not as described, we reserve the right to decline the Direct Buyout.
f. Any Item determined to be inauthentic will be returned to you at your expense.
2. Acceptance and No Obligation
a. You are under no obligation to accept a Direct Buyout offer.
b. Where a Direct Buyout offer is declined, the Item may be returned to you at your expense or considered for Consignment, subject to these Terms.
3. Transfer of Ownership
a. You warrant that you are the legal owner of the Item and have full authority to sell the Item to us.
b. Upon acceptance of a Direct Buyout offer, you agree to sell, assign and transfer to us full ownership, title and interest in the Item.
4. Payment
a. Payment for Items purchased via Direct Buyout will be made to your nominated bank account within three (3) business days of acceptance, unless otherwise agreed in writing.
b. We may withhold or offset payment where any amounts are owed to us, including for repairs, authentication, shipping or other services.
5. Post-Purchase Rights
a. Upon payment, you acknowledge that you have no further right, title or interest in the Item.
b. You further acknowledge that you have no entitlement to any future proceeds arising from the resale of the Item.
c. We retain sole discretion in relation to the pricing, restoration, marketing and resale of any Items acquired through Direct Buyout
6. Risk and Liability
a. Risk in the Item remains with you until such time as full payment has been made by us.
b. To the extent permitted by law, we are not liable for any loss or damage to Items while in transit to us.
8. Use of Site
Use of the Site is at your own risk. Everything on the Site is provided to you on an “as is” and “as available” basis, without warranty or condition of any kind.
None of the affiliates, directors, officers, employees, agents, contributors, third party content providers or licensors of Effe (including any third party delivery services) make any express or implied representation or warranty about content referred to on the Site.
This includes (but is not restricted to) loss or damage you might suffer as a result of any of the following:
a. Failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorized access to records.
b. The accuracy, suitability, or currency of any information on the Site, the services, or any content (including third party material and advertisements).
c. Costs incurred as a result of using the Site.
d. Operation in respect to links provided for convenience.
e. Any failure to complete a transaction, or any loss arising from e-commerce transacted on the Site.
f. Any defamatory, threatening, offensive, or unlawful conduct of third parties.
9. Intellectual Property Rights
a. The information, names, text materials, graphics, logos, button icons, images, video and audio clips, trade marks (whether registered or not), advertisements, layout, arrangement, graphical user interface, look and feel, and control features of the Site (the “Content”) is protected by Intellectual Property Rights.
b. The Content, the Software, and the Site are protected by copyright laws and other Intellectual Property Rights. You acknowledge that we are the owner of these rights, with our affiliates or other third-party licensors.
c. All product and company names and logos contained within the Site are the trade marks, service marks or trading names of their respective owners, including us.
d. You acknowledge and agree that no right, title, or interest in any of the Intellectual Property Rights in the Content, the Software, or the Site is transferred or granted to you, other than the rights granted expressly by these Terms and Conditions.
e. You agree that:
i. Any Intellectual Property Rights created, formulated, or discovered by you through the use or access to the Software or the Site will be the sole and exclusive property of us.
ii. You will promptly sign all documents and do all things necessary to register, vest or transfer any interest or ownership in such Intellectual Property Rights to us.
10. Use of Personal Information
a. Customers who have entered their email into our site will only be subject to marketing emails if they opt in.
b. Marketing emails may include promotional content, vouchers, or general marketing emails.
c. We may share customers’ personal information with our affiliated business Evans Leather Repair, in the form of marketing emails, promotions, and vouchers.
d. Personal information will only be kept for durations in line with the law.
e. By submitting your data to our website you consent to cross transmission of data between our social media pages, and with our affiliated business Evans Leather Repair.
f. Customers can unsubscribe from marketing emails at any time.
11. Personal Information Collection
a. When creating an account or purchasing an item, you will be required to provide personal information including name, email, postal address, and phone number.
b. This information is required to use our services and may be disclosed to third parties unless opted out.
c. Failure to provide this information may impact your ability to use our services.
d. Our platforms are not intended for children under 13.
e. Sensitive personal information will only be collected with your consent.
12. Data Quality and Access
a. Personal information can be updated or removed by contacting hello@effe.com.au.
b. Requests will be handled within a reasonable timeframe.
c. In some cases, deletion or modification may not be possible.
13. Limitation of Liability
a. To the maximum extent permitted by law, Effe is not liable for indirect, incidental, or consequential damages.
b. Total liability is limited to the amount paid for the product.
14. Governing Law and Jurisdiction
a. These terms are governed by the laws of Victoria, Australia.
b. Any disputes will be handled in the courts of Victoria.
15. Cookies and Data Collection
a. We use third-party analytics tools to measure traffic and usage.
b. Cookies may be used to enhance your experience.
c. Data collected is generally statistical and not personally identifiable.
d. Third-party providers may also use cookies.
e. Log data such as IP address, browser type, and pages visited may be collected.
